Communique: October 14, 2014
- One of the composite decision taken at the last meeting of the Collegium representatives held on Sept 28, 2014, related to the filing of legal proceedings against the builder, in the matters of (i) maintenance charges, (ii) bungling in electrical charges and (iii) retrieval of security deposits of the allottees with the Management and the eventuality of taking over the maintenance services minus the roads and electricity, for which a total expenditure was approved in principal as Rs.5.00 lakhs. The minutes of the said meeting are under issue. In the meantime, the Governing Body meeting held on the 13th October, considered the modalities for implementing this decision. During the discussion it transpired that the funds of RWA consist mostly of the membership fee. An idea was mooted that all the residents of Ardee City be requested to come forward to contribute @ Rs.1000/- each to constitute a dedicated account for pursuing the proposed legal proceedings. It would be necessary otherwise also, since as per the legal practice, the relief awarded by court is available only to those who seek it. In order to ensure that all the residents are benefited by the relief that becomes available through these proceedings, it would be essential that all the petitioners are valid members. We look forward to your comments in this matter.
- It has also been reported that as a result of the action of the residents to deposit the maintenance bills in the ESCROW account, the builder has resorted to unfair means like not accepting payment of the electricity bills without the maintenance bills. It may be stated here that the Vice President of Ardee Shri Hasija has given in writing to the Police Commissioner that electricity bills would be accepted without insisting on the maintenance bills. Besides, they are also tempering with electrical fuses and electric meters to cause harassment to the residents. Another FIR is being filed with the Police Commissioner by RWA in his regard, requesting them to take immediate action against the Ardee management on the basis of our earlier FIR and the statement of Shri Hasija and to ask the management to desist from such attitude which could lead to severe legal/criminal consequences.
